GREG KELLY (HOST): According to Donald Trump, the Department of Justice owes him $230 million dollars. I have to disagree with the president on this one. President Trump, you're wrong. The DOJ does not owe you $230 million dollars. All right. They owe you $1 billion dollars. They owe him a billion. All the stuff they put him through with all those fake indictments. You got to add it all up. Now, possibly that was all the money that was out of his pocket. So you want to look at it that way? But there was also the opportunity cost and the time they spent in the courtroom. That's time. Time is money. I think they owe him for that, too.
...
KELLY: Joe, first to you. Is this just a crazy idea or is it a possibility that he could be compensated?
JOE DIGENOVA (GUEST): Oh, it's a it's a definite possibility. The law provides for compensation in circumstances like this. They have filed appropriate papers, Trump's lawyers, before the inauguration asking for compensation in two cases — the Mar-a-Lago raid and the investigation of the Russiagate — Crossfire Hurricane, and all the money that was spent on all of those. I happen to think that the $230 million dollars is a lowball estimate. It's obviously much higher than that. Even though most of the fees were paid for by campaign committees, it's money that came from Trump Enterprises or Trump organizations. So I don't think there's going to be any problem getting the settlement.
I heard somebody on Newsmax say today that the Justice Department lawyers had a conflict of interest. That may or may not be the case. If it is a case that conflict can be waived by the department and waived by the president.
And let's remember one thing — the executive branch consists of one person, the president of the United States. That means he's the chief law enforcement officer. He has the power to settle this case, even though it involves his own interest. And the reason for that is very simple, there is no one else to make the decision.
