Fox News hyped Trump’s fake electors scheme. He just got indicted for it.

Former President Donald Trump was indicted Tuesday on multiple federal charges connected to his criminal schemes to keep himself in power after losing the 2020 election, which culminated in a violent attack on the U.S. Capitol by a mob of his supporters. At this historic moment, it is also worth reexamining the public role that Fox News played in promoting one of Trump’s key efforts to stay in power — and which is now the central crime in the indictment — by creating fake Electoral College votes in states where Joe Biden had won the popular vote.

The August 1 indictment charges Trump with conspiracy to defraud the United States, and details the manner in which he and six unnamed co-conspirators manufactured the fake electoral votes. This scheme essentially involved a bait-and-switch, at first justifying the fake elector slates as a contingency plan in case a recount or court case were to flip a state’s election result in his favor, in line with a historical precedent from Hawaii’s presidential recount in 1960. However, even after no such results were flipped — indeed, Trump lost a state recount as well as dozens of legal challenges — he and his co-conspirators still attempted to convince then-Vice President Mike Pence to treat the fake electors as if they were real, and to reject the certification of real electoral votes for Biden.

The indictment also charges Trump with obstructing an official proceeding (the counting of the electoral votes on January 6, 2021) and engaging in a conspiracy against Americans’ civil rights to have their votes counted, based on his refusal to immediately tell his supporters to leave the Capitol, and that he and co-conspirators sought to use the violence as a means to further delay the electoral count. These further counts, in a sense, simply stem further out from the fraudulent electors scheme itself.

Two weeks ago, on July 18, Michigan Attorney General Dana Nessel announced state charges against the 16 fake Trump electors in her state, on counts of forgery punishable by up to 14 years in prison. In addition, the Trump campaign’s fake electors in Georgia could also face charges in the ongoing probe by Fulton County District Attorney Fani Willis of Trump’s efforts to subvert his election loss in that state. Eight of Georgia’s fake electors have already accepted an immunity deal, indicating that they could potentially provide evidence against other figures in the Trump campaign.

Fox News played a major role in promoting the fake electors conspiracy at the time, including hosting the major public announcement of the scheme on the morning of December 14, 2020, the day when the Electoral College delegates voted across the country. Fox hosts and guests repeatedly invoked Trump’s false claim that Congress or the vice president could simply treat the fake electoral votes as real ones, or that they presented some legitimate rival claim despite not having the certification of any state authority.

  • On Fox & Friends, former Trump White House adviser Stephen Miller hyped “an alternate slate of electors in the contested states.” Miller said: “As we speak, today, an alternate slate of electors in the contested states is going to vote, and we're going to send those results up to Congress. This will ensure that all of our legal remedies remain open.” In addition to claiming that Trump could win a court case on the election results, Miller added, “And likewise, Congress has that opportunity as well to do the right thing,” suggesting that Congress might simply count the false electoral votes instead of the genuinely certified Biden slates.   • Fox contributor and law professor Jonathan Turley on Fox & Friends coined the Trump fake elector plan as “the Death Star strategy” while talking about its history and odds of success. Turley said, “It’s very hard to do and it’s very unlikely to succeed. But they can force a question to the presiding officer, who would be Vice President Pence.” [Fox News, Fox & Friends, 12/14/20]

  • Fox national correspondent Bryan Llenas uncritically reported that “Republican electors in Pennsylvania and Georgia met separately to cast their own votes for President Trump just to keep all legal options open.” On Fox’s Special Report, Llenas echoed Miller’s phrasing of the fake electors as a “legal” precaution, saying: “The historic Electoral College vote occurring as President Trump continues to contest the election results. In fact, Republican electors in Pennsylvania and Georgia met separately to cast their own votes for President Trump just to keep all legal options open.” [Fox News, Special Report, 12/14/20]

  • Fox anchor Martha MacCallum: Fake electors were voting “in solidarity with” Trump’s effort to “keep on fighting until the bitter end.” On her Fox “news”-side program, MacCallum said: “The Trump team says it will keep on fighting until the bitter end on January 20,” which she incorrectly said is “when Congress makes the final certification.” She continued: “In solidarity with that today, Republican electors in Pennsylvania and Georgia went ahead and cast protest votes in favor of President Trump, in hopes that a future lawsuit might succeed. This has actually worked once before in the state of Hawaii back in 1960, when Democrats challenged Richard Nixon's victory and flipped the state to John F.   • Then-Fox Business host Lou Dobbs legitimized the efforts of the fake electors. Dobbs uncritically reported that “Republican electors in Pennsylvania, Nevada, and Georgia meeting separately today to cast their own votes for President Trump — a procedural move that keeps all of President Trump's legal options open.” [Fox Business, Lou Dobbs Tonight, 12/14/20]

  • On his separate radio show, Fox host Mark Levin falsely claimed the fake electors were “sent by” the states, and specifically endorsed the fake Michigan electors fraudulently swearing that they met at the state Capitol. Levin said: “Now, as this process goes on, it does become harder and harder and harder to reverse course. But the final step is on January 6. January 6. Now, Pennsylvania and Georgia, the Republicans in those states have sent alternative votes, or are, to the archivist of the United States.” He then specifically legitimized the fake Michigan electors, saying: “The Michigan Republicans were going to do exactly the same thing, but the fascistic governor there literally had state troopers block the legislative entry so the electors couldn't meet, the Republican electors, to send their electors to the archivist. I suppose they could meet somewhere else.” (The state’s Republican legislative leaders had publicly explained that the state Capitol building was closed to the public due to credible threats of violence.)   • Dobbs continued to promote the fake elector scheme and the possibility that the Republicans in the House could name Trump as president. The next day, Dobbs said: “Seven states have chosen a slate of electors for both Joe Biden and President Trump. They are Pennsylvania, Georgia, Michigan, Wisconsin, Arizona, Nevada, and New Mexico. Now, if the House and the Senate cannot agree on which electors to accept, an untested constitutional procedure could result in each state being given one vote, which they would allocate to either Biden or Trump. And since the Republicans hold 26 of 50 statehouses, there would exist at least the mathematical possibility that President Trump could be named the constitutionally elected president.” [Fox Business, Lou Dobbs Tonight, 12/15/20]

  • Dobbs declared “it’s shameful” that the fake Michigan electors were barred from the state Capitol, while his guest Phill Kline promoted the fake electors scheme. After Kline complained that the Democratic governor “effectively chained the doors of the Michigan legislature and prohibited Republicans from coming in,” Dobbs said: “Putting the state police to guard the door against Republican electors. … It’s shameful.” Kline then legitimized the scheme by pointing to historic examples of different electors being presented, while calling for continued investigations of fake election fraud claims.   • Fox Business guest Ken Blackwell falsely claimed that Joe Biden was not the president-elect because “seven states are sending competing slates of electors to the Congress.” Blackwell continued pushing the fake elector scheme as a way to “really push this through” and reelect Trump.   • On Hannity, then-Trump administration press secretary and campaign spokesperson Kayleigh McEnany mentioned “an alternative slate of electors” that may change the outcome of the election. McEnany said: “In the four states that we saw a lot of problems and with those big metro areas, the only metro areas where Joe Biden beat Hillary Clinton, ironically. In those states, there has been an alternative slate of electors voted upon, that Congress will decide in January. So, we will see what happens.” [Fox News, Hannity, 12/17/20]

  • Fox Business anchor Maria Bartiromo approvingly played a video clip of online right-wing personality Christian Walker touting the fake electors. In the clip, Walker declared: “And for your information, seven states sent their GOP electors to vote for Trump today: Pennsylvania, Georgia, Michigan, Wisconsin, Arizona, Nevada, New Mexico. This preserves President Trump's right to remedy the fraud with his own electors.
