AINSLEY EARHARDT (CO-HOST): This just shows you how political this is. They don't know even know who the director is going to be. Before they even name a director, the Democrats are already saying we are not going to support that person, no matter if we love him or not. They love Judge Merrick Garland.That's one of guys being thrown out. [Senate Majority Leader] Mitch McConnell [(R-KY)] said he would be a great acting --

BRIAN KILMEADE (CO-HOST): Senator Mike Lee’s [(R-UT)] idea, originally.

EARHARDT: But the Democrats are saying, including [Senate Minority Leader] Chuck Schumer [(D-NY)], we don’t care who it is. We’re blocking it, unless there’s a special prosecution.

STEVE DOOCY (CO-HOST): Also we should point out [Democratic] Senator Mark Warner of Virginia also said that the attorney general, Jeff Sessions, should play no role in the selection of the FBI director because he recused himself from the Russia thing. Keep in mind, the FBI is a simply one part of the Department of Justice and the Russia thing is important, we heard at the FBI. But, still, there are a lot of things going on at the Department of Justice not impacting. So that's kind of a crazy thing.

EARHARDT: Well, maybe they don't want an FBI director to be put in place because there was talk of Hillary Clinton being -- that case being opened again and investigated.
