Newsmax's Greg Kelly suggests an investigation into John Durham

FRED FLEITZ (GUEST): Well. it does. And it falls to the FBI for accepting any fragmentary or half-baked allegation. As long as it's anti-Trump, the FBI never bothered to check it with other intelligence sources. But, you know, I think I'm with Joe diGenova on this. This report has been written for four years. It should have come out before the 2020 election. This is making the perfect the enemy of the good. We needed a report that, basically, answered the mail, said there was collusion, the Clintons were involved in it. But, instead, Durham dragged this out to a point where it just doesn't matter now. And I don't think anybody's gonna be held accountable.

GREG KELLY (HOST): And did he slow walk it on purpose? Joe, can you tell me that? I suspect as much. And if you care to respond to what Dick said. 

JOE DIGENOVA (GUEST): Well, I don't know whether he slow-walked it or not, but it ended up being slow-walked, so it doesn't matter what his intention was. When you're – I was an independent counsel, and I was also a United States attorney. This is like the investigation of Hunter Biden in Delaware going on for five years. These cases can all be bright within six months, And I agree with Fred. This should have been brought before the 2020 election. It's useless now. I don't disagree with Dick that it has implications historically, and his wife obviously was prescient. She knew this before the last election. So the bottom line is this – I wanted indictments. We needed indictments. People like James Comey and others should have been indicted. They weren't. This is now a free ticket. Do you think that the people in the FBI who conspired to deny Donald Trump his civil rights care one wit about this? They do not. They would have cared about having to spend a million dollars to defend themselves in a criminal case. But this is extremely disappointing, even though I agree with everything that Dick said that it's gonna have implications. But it's too late. It's too late.

KELLY: You know, fidelity, bravery, and integrity - that is somehow the motto of the FBI. Even Durham says they don't – that they're not living up to that. I think bureaucratically inside the Beltway, this is more of a gut punch then somebody like me would see at first glance. But, anyway, Dick, final word.

DICK MORRIS (NEWSMAX CONTRIBUTOR): Yeah, you're looking at it from a judicial perspective. I'm a politician. My goal is to win the next election in '24. This gives Trump an enormous weapon to win this election. It gives us something to say in the election and campaign on. You guys can only begin to imagine the impact that this is going to have. You just sit back and watch what the Trump campaign does with this –

KELLY: And Fred –

MORRIS: And you won't come back and say this was useless. You'll be thanking your lucky stars that it happened. 

KELLY: Fred, final final word, if you don't mind, 10 seconds.

FLEITZ: I think Dick's probably right. But look the cloud of what happened 2016 was still haunting Trump in 2020. Dick's right - it might help Trump in '24, but he might have won the election in 2020 if this report had come out before the 2020 election. I'm sure that would have happened. 

KELLY: And John Durham -- I mean the pace of this thing. Totally -- maybe we need an investigation into that.
