GREG KELLY (HOST): I got confronted by a couple of liberals at a party this weekend. And I made the case, but I think you can make it better — they're like habeas corpus, habeas corpus. Habeas corpus is great, but I don't think it applies to an illegal alien. There is a due process, but it doesn't necessarily, or probably should not require a courtroom. Can you explain it a little bit better than I just did, please?

TOM HOMAN (GUEST): Well, they need to read the law because there are certain levels of due process. You know, you got expedited removal that you don't have the right to see a judge. You got voluntary return, you voluntarily return. But it's like the Alien Enemies Act that everybody's raising hell about right now. They didn't get due process. There's a different level of due process for different standards. The Alien Enemies Act was written by Congress, passed by Congress, signed by a president. They got less due process because they've been designated an alien — an enemy of the United States. They don't get the same due process as a Title VIII, somebody wants to make a claim for asylum or something. I can guarantee you, everybody we arrest, everybody we remove has a form of due process as outlined by federal statute. Matter of fact, this facility they attacked in Texas, in El Dorado, that is a place we give due process. That's the place we detain people that have immigration hearings and they're deported. That's where we have due process, and that's the place they attack and try to kill ICE agents. So everybody gets due process at a certain level.
