On The O'Reilly Factor, Fox News senior judicial analyst Andrew Napolitano accused “the left” of being “desperate to keep a Catholic off the [Supreme] Court.” Napolitano made his comment during a discussion with host Bill O'Reilly and former Planned Parenthood chief executive officer Gloria Feldt of a NARAL Pro-Choice America ad that criticizes Supreme Court nominee John G. Roberts Jr. After Napolitano's slur, O'Reilly commented that "[t]hey'd love to have [former New York Gov.] Mario Cuomo on the court, and he's Catholic." Napolitano agreed, saying, “That's a Catholic they'd like.”

From the August 9 edition of Fox News' The O'Reilly Factor:

FELDT: And anyone who wants to sit on the United States Supreme Court should answer questions of this nature.

O'REILLY: I'm with you on that.

FELDT: They are fundamental, they are important.

NAPOLITANO: The left is so desperate to keep a Catholic off the court, they are accusing him of doing things they know he didn't do.

FELDT: Oh, come on. That is the most tortured logic I've ever heard.

O'REILLY: That's another issue. I can't get into that, but I will tell you this. They'd love to have Mario Cuomo on the court, and he's Catholic.

NAPOLITANO: That's a Catholic they'd like.

O'REILLY: All right. Fair?

FELDT: Fair.

O'REILLY: Thank you.

NAPOLITANO: You are fair, Bill.

O'REILLY: Once in a while. Thank you both.
