STUART VARNEY (HOST): Judge, I am going to be a little extreme. Seems to me the fix is in.

ANDREW NAPOLITANO: I don’t think that’s extreme at all, Stuart. I think there’s a lot of evidence for it. The next time you dip into this hearing, you’re going to see there are two hearings going on. The Republicans are asking about the decision not to indict Mrs. Clinton and the meeting with Loretta Lynch and Bill Clinton. The Democrats are asking about gun control and whether or not the tragedies of last week would have happened if we had different laws about gun control. Two entirely different dynamics being played out at the same time, and in the same place, and for different political reasons.

VARNEY: That’s right. When the hearing began the opening question from the chair, Goodlatte, was -- his opening statement I should say, was all about the email chain, the email scandal, the FBI's handling of that scandal. But when Loretta Lynch started her opening statement it was all about Dallas, it was all about gun control. And the same with the Democrat congressman who just asked a question which she is now answering -- all about guns in Dallas.

NAPOLITANO: Correct, which is of course what she’d prefer to talk about because when she is forced to talk about the FBI and the email investigation, she doesn't want to give an answer.

VARNEY: It’s a complete avoidance of what she is there to answer questions on. Is it not?

NAPOLITANO: Makes one wonder if she knew what the FBI recommendation would be before she decided to accept it blindly, without any internal evaluation of it.

VARNEY: Pete Hegseth, he’s been sitting on the set, he’s snuck on the set. He’s been listening to and watching all that’s going on. Can I ask for your impressions thus far?

PETE HEGSETH: You said it right, Stuart. It makes you feel like the fix is truly in. This decision was to be had beforehand, she knew what the FBI was going to recommend.
